• We reserve the right to modify or remove platform functionalities.
• Access to certain features may require an active subscription.
• We do not guarantee uninterrupted platform availability.

3. Payments and billing

• Payments are processed through secure third-party providers, including Stripe.
• Users must provide accurate and updated billing information.
• Stripe fees may vary depending on payment method or location.
• Fluxum is not responsible for errors or delays caused by payment processors.
• Access may be suspended in the event of payment disputes or failures.

4. Delivery of digital services

• Fluxum is a SaaS platform delivered exclusively online.
• Access is normally available after account creation or payment confirmation.
• Temporary interruptions may occur due to maintenance or updates.
• Fluxum is not responsible for downtime caused by third-party services.
• The platform may be updated and improved periodically.

5. Refund policy

• Payments made to Fluxum are non-refundable once access has been activated.
• Digital services are considered delivered immediately after activation.
• Refunds granted to club members are solely the responsibility of the clubs.
• Fluxum is not part of the contractual relationship between clubs and their members.
• Any future special refund policies will be communicated separately.

6. Intellectual property rights

• Fluxum and all its elements are the property of NOMADIC DIGITAL SRL.
• Copying or commercial use without written consent is prohibited.
• Using the platform does not transfer intellectual property rights.
• Content uploaded by clubs remains their property.
• Fluxum is not responsible for copyright violations caused by users.

7. Limitation of liability

• Fluxum is provided “as is”, without explicit or implied warranties.
• Fluxum is not liable for indirect damages, profit loss or data loss.
• Fluxum is not responsible for decisions made based on platform information.
• Total liability is limited to amounts paid during the last 12 months.

8. Relationship between Fluxum, clubs and members

• Fluxum is a technology platform and does not provide sports services.
• The relationship between clubs and their members is independent from Fluxum.
• Fluxum is not responsible for sports accidents or incidents.
• Clubs are responsible for complying with applicable laws.

9. Suspension and termination of access

• Fluxum may suspend access for violation of these terms.
• Access may be restricted for fraudulent or illegal activities.
• Termination of access does not entitle users to refunds.

10. Force majeure

Fluxum shall not be held liable for failure to perform obligations due to force majeure events, including disasters, cyberattacks or infrastructure failures.

11. Governing law and jurisdiction

These Terms and Conditions are governed by the laws of Romania.

12. Subscriptions and plans

14. Payments processed through Stripe

• Fluxum uses Stripe to process payments.
• Stripe may handle transfers and processing fees.
• Stripe is responsible for payment processing and distribution.
• Financial documents are available in the Stripe account.
• Fluxum does not issue Stripe financial documents.
• Users must manage financial information directly in Stripe.
• Fluxum is not responsible for Stripe compliance procedures.
